Terms of Service

These Terms of Service (“Terms”) govern your use of the FishTrip mobile application and the services available at fishtrip.fun (together, the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

In these Terms “we,” “us,” and “FishTrip” refer to the provider above. “You” refers to the person using the Service.

2. The Service

FishTrip is a mobile app for planning and logging fishing trips. Its core features include creating trips, adding catches with photos and metadata, AI-assisted fish species detection, an interactive map, voice messages, weather information, and social features such as a shared gallery and leaderboard. Features may be added, changed, or removed over time.

3. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country) to use the Service. If you are under 18, you confirm that your parent or legal guardian consents to your use of the Service on your behalf.

We may remove content or suspend accounts that violate these rules, at our reasonable discretion and in most cases after notifying you.

6. User content and licence

You retain all rights to the content you create in the Service — including catch photos, voice messages, trip descriptions, and notes (“User Content”).

To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resizing images), and display your User Content solely for the purpose of providing the Service to you and to trip participants you have granted access to. This licence ends when you delete the content or your account, except for backups that are overwritten in the normal course of operations.

You represent that you own or have the necessary rights to your User Content and that it does not infringe the rights of any third party.

7. Content moderation and reporting

We take user-generated content seriously and moderate reports around the clock. This section explains what tools you have and what we do when someone reports content.

Your reporting options

Every piece of user-generated content in the app has a report action. Tap the overflow menu () on a catch, a gallery photo, a comment, a voice message, or a user profile and pick the appropriate Report … item. You will be asked to choose one of these reasons and can add an optional description of up to 500 characters:

Reports are sent directly to our moderation team. Your identity as reporter is treated as confidential — we never disclose it to the reported user or to other users.

Blocking users

You can block any user directly from a catch, photo, comment, voice message, or profile. Blocking is symmetric: once you block someone, you and that user will no longer see each other's catches, photos, comments, voice messages, or trip invitations. You can view and manage your blocked list at any time under Settings → Blocked Users and unblock a user with a single tap. Blocking is a personal preference and is separate from moderation — blocked users are not sanctioned by us, they are just hidden from your feeds.

Our review process

Reports are triaged by priority. Reports concerning child safety or impersonation are marked HIGH and reviewed within 24 hours. All other reports are reviewed within 7 days. Depending on the outcome of the review, we may take one or more of the following actions:

Every action is written to an immutable audit log; content and account records are never hard-deleted, so we can produce a full trail on request from you, from Apple or Google, or from a regulator.

Reports about serious harm

For reports involving child safety, threats to life or bodily harm, or other serious illegal activity, we may share the report and the reported content with law enforcement authorities to the extent required by law. We may also proactively take content down before a formal review completes if the risk warrants it.

Abuse of the reporting system

You may not submit false or bad-faith reports. To limit abuse, the number of reports a single user can submit within a 24-hour window is rate-limited. Repeated bad-faith reporting may result in your account being suspended.

8. AI fish recognition

The Service uses the third-party Fishial Recognition API to suggest fish species from catch photos. Suggestions are provided for convenience and may be inaccurate. You are solely responsible for the correctness of the species information you record and for complying with local fishing regulations, minimum sizes, and closed seasons.

9. Third-party services and content

The Service integrates third-party services (Sign in with Apple, Google Sign-In, Firebase Cloud Messaging, OpenStreetMap tiles, weather providers, Fishial Recognition, and others). These services are governed by their own terms and privacy policies. We are not responsible for the accuracy, availability, or content of third-party services.

10. Fees

The Service is currently offered free of charge. We may introduce paid features or subscription plans in the future; if we do, we will describe the pricing, billing terms, and cancellation options clearly before you are asked to pay.

11. Advertising

The Service does not currently show advertising. We reserve the right to introduce advertising in future versions of the Service to support its ongoing development. Any advertising will comply with applicable law and with our Privacy Policy, in particular:

You acknowledge that when advertising is enabled, the Service may display third-party content over which we have limited control. We are not responsible for the content or accuracy of third-party advertisements.

12. Intellectual property

The Service, including its software, design, branding, and the FishTrip name and logo, is owned by us or our licensors and protected by intellectual-property laws. Nothing in these Terms transfers ownership of the Service to you. You receive only a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.

13. Service availability

We aim to make the Service available at all times but we cannot guarantee uninterrupted or error-free operation. We may perform maintenance, modify features, or discontinue parts of the Service. We will give reasonable notice of any material discontinuation.

14. Warranty disclaimer

Except as required by applicable consumer law, the Service is provided “as is” and “as available” without any express or implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your specific requirements or that any errors will be corrected.

15. Limitation of liability

To the maximum extent permitted by law, we are liable only for damages caused by intent or gross negligence. In the case of slight negligence, our liability is limited to damages arising from a breach of an essential contractual obligation (an obligation whose fulfilment makes the proper execution of the contract possible in the first place and on whose observance you may regularly rely) and is limited to the foreseeable, contract-typical damages.

Mandatory statutory liability under the German Product Liability Act (Produkthaftungsgesetz) and for damages resulting from injury to life, body, or health remains unaffected.

16. Indemnification

You agree to indemnify and hold us harmless from any third-party claims, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your unlawful use of the Service. This does not apply where a claim results from our intent or gross negligence.

18. Governing law and dispute resolution

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection laws of your country of residence remain unaffected.

The European Commission provides an online dispute resolution (ODR) platform available at ec.europa.eu/consumers/odr. We are not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

19. Changes to these Terms

We may update these Terms from time to time. If a change is material we will notify you in the app or by email at least 14 days before it takes effect. Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms. If you do not agree, you can delete your account before the change takes effect.
